Walnut Court Class Action Settlement

A preliminary settlement agreement has been reached in the Class Action known as Theresa Allen and Gary Montgomery, individually and on behalf of all others similarly situated v. 315 Walnut Co-Op, Inc. and Larson Management, LLC, Black Hawk County District Court, LACV148953

The Representative Plaintiffs for the Settlement Class are Theresa Allen and Gary Montgomery. They are represented in part by WANDRO, KANNE, & LALOR, P.C. Plaintiffs brought this lawsuit against the Defendant on behalf of specified current and former residents and tenants of the Defendant. The Petition alleges that the Defendant violated the law because the property was constructively uninhabitable due to the bed bug infestation, and that Defendant’s failure to remedy the infestation was a material breach of contract, among other allegations. Plaintiffs have sued the Defendant to recover compensatory and statutory damages. Plaintiffs are also seeking attorneys’ fees, costs, and interest in this lawsuit. The Defendant denies all allegations of wrongdoing, liability, and charges.
