Wandro & Associates P.C. Partners with Marler Clark LLP PS, Files Lawsuit Against Fresh Express Over

Wandro & Associates has joined Marler Clark LLP in filing a lawsuit against Fresh Express related to the recent outbreak of Cyclospora in their bagged Hy-Vee Brand Garden Salads. The current outbreak has also been linked to salads sold at Aldi and Jewel-Osco stores in the region. Cyclosporiasis is an illness caused by a microscopic parasite that can infect a person who has eaten contaminated food and can cause symptoms such as diarrhea, loss of appetite, nausea, and more. As of June 26, 2020, there have been 206 reported cases and 23 hospitalizations related to the outbreak with most of the confirmed cases reporting that they bought HyVee Brand Garden Salad manufactured by Fresh Express. There have been confirmed cases in several other states including Illinois, Kansas, Missouri, Minnesota, Wisconsin, Nebraska, and South Dakota.

Illnesses related to this outbreak started on dates ranging from May 11, 2020 to June 15, 2020. HyVee has recalled the tainted salads and has also recently extended this recall to an additional 12 salads that may be related to the current Cyclospora outbreak. If you have purchased ALDI Little Salad Bar Brand Garden Salad, Hy-Vee Brand Garden Salad, or Jewel-Osco Signature Farms Garden Salad that was purchased at HyVee, Aldi, or Jewel-Osco you should not eat it. To get a full list of all of the recalled products, their UPC numbers, use-by dates, and states in which the products were distributed, you can view Fresh Express’s press release.

If you have consumed any of these products and have become ill as a result, call Wandro & Associates at 515.281.1475 to speak to an attorney.
